 Company Formation in PolandFormation and Location of Company in Poland Over the past few years Poland has quite developed its position as a leading locality for foreign investors in the Middle and North Europe. For the Austrian companies Poland offers interesting perspectives on the ground of lower costs of production. In the last year, the legal and infrastructural framework conditions for foreign investors improved with Poland´s entrance into the European Union. Since 1 May 2004, according to the Entrance Agreement between the member states of the European Union and the Polish Republic, the principled European legal regulations are also valid in Poland. They refer to the original agreements of the EU (for example the European Union Association Agreement) as well as the legal acts of the European Union Authorities which have been issued up to now (directives and regulations). According to the Article 43, subsection 1 of the European Union Association Agreement, restrictions of free branches are in principle forbidden. The freedom of branches includes reception and practising of self-employed gainful activity as well as company formation and management (Companies of the Civil and Trade Law) after an adjustment of the present member states. Temporary arrangements for this area do not occur. It means that since the entrance of Poland into the EU, the Austrian companies have enabled, through the national Polish law, a possibility of using forms of companies including branches as well as representation for their economic actual.
