Trade Law in Portugal
EU citizens can perform their activities in Portugal in any economic sectors, that are available for the private sector according to Portugal legislative under the same conditions as the Portuguese people. A special education and tests are not required to form the company. The principle of trade liberty is applied to here, whereby all traders must be recorded in the State Register.
Generally, the access to trade in Portugal is free with relatively few eventual exceptions. It means in praxis, that everybody, who supposes to have sufficient knowledge, can form a company. For formation of a company only general regulations apply.
The exceptions to this free access to trade are specified by law and these cases assume the compliance with various conditions and the application for so called 'Carteira Profissional' must be submitted. These provisions cover the following professions: employees of gambling houses, journalists, football couches, building foremen, personal agents, geodetic engineers, nurses, hairdressers, cosmeticians, masseurs, pharmacists, employees in hotel business, psychologists, dentists, producers of dentures, tourists guides, persons dealing in movie industry, movie translators, loaders and unloaders of burdens, cargo inspectors in ports.
